1. Services ProvidedDJ agrees to provide professional wedding DJ/MC services including: professional sound system; wireless microphones; dance floor lighting; uplighting (if included in the selected package); Master of Ceremonies services; planning consultation(s); and timeline coordination assistance.DJ agrees to perform in a professional and polished manner consistent with industry standards.
2. Payment TermsA non-refundable retainer of 50% is required to reserve the event date. The remaining balance is due no later than 30 days prior to the event date.No date is secured until both the signed Agreement is received and the retainer payment is received. Failure to submit final payment by the due date may result in cancellation of services without refund of the retainer.
3. Cancellation PolicyClient cancellation: all retainers are non-refundable. More than 60 days before the event — retainer forfeited. Within 30 days of the event — full remaining balance may be owed. This protects the DJ from loss of other booking opportunities.DJ cancellation: if DJ is unable to perform due to illness, emergency, or circumstances beyond reasonable control, DJ will make reasonable efforts to secure a qualified replacement of equal professionalism. If no replacement can be secured, all payments received will be refunded and DJ shall have no further liability.
4. OvertimeOvertime is available at the hourly rate stated above. Overtime must be approved by Client and venue and is payable before or at the time of extension.
5. Client ResponsibilitiesClient agrees to provide: one 6' or 8' sturdy table for DJ setup; a tent or covering for outdoor events to protect DJ equipment unless waived; one grounded electrical outlet within 25 feet; venue access at least 2 hours prior to performance; and a safe, secure working environment.Client assumes responsibility for damage caused by guests or venue staff.
6. Music Selection & Creative ControlClient may provide a must-play song list, a do-not-play list, and cultural or specialty music preferences.DJ retains professional discretion regarding song selection, transitions, and crowd reading to maintain dance floor energy. DJ is not responsible for guest song requests that conflict with Client instructions.
7. Timeline & CoordinationClient agrees to complete all planning forms no later than 60 days prior to the event.DJ is not responsible for timeline delays caused by catering delays, venue restrictions, photographer overruns, or late guest arrival.
8. Liability & LimitationDJ is not liable for power outages, venue sound limitations or noise ordinance enforcement, weather interruptions, guest misconduct, or equipment damage caused by third parties.DJ's total liability shall not exceed the total amount paid under this Agreement.
9. Force MajeureNeither party shall be liable for failure to perform due to acts beyond reasonable control, including natural disasters, government restrictions, or public health emergencies. Payments may be transferred to a mutually agreed rescheduled date within 12 months.
10. Media ReleaseClient grants DJ permission to use photos and video from the event for promotional purposes, including website, social media, and marketing materials.
11. Governing LawThis Agreement shall be governed by the laws of the Commonwealth of Massachusetts. Any disputes shall be resolved in Massachusetts courts.
12. Entire AgreementThis Agreement constitutes the entire understanding between both parties. No verbal agreements shall modify this contract.
